The Regulation On Pollutant Emission And Transport Registration Is Published. 16 December 2021

The “Regulation on Pollutant Emission and Transport Registration” (“Regulation”) prepared by the Ministry of Environment, Urbanization and Climate Change (“Ministry”) was published in the Official Gazette dated 4 December 2021. In the Regulation, the procedures and principles for the creation of a record of the emission and transport of pollutants are regulated in order to protect the environment and reduce environmental pollution originating from industrial and non-point sources.

Obligations and Period

Accordingly, the operators of the facilities specified in the Regulation will register their facilities in the Pollutant Emission and Transport Registry (“PETR”) system and will annually report to the Ministry on matters that require reporting, such as the amount of emission of pollutants into the air, water and soil.

Enterprises operating within the scope of the regulation have to fulfill their PETR registration obligations;

  1. If they are functioning on the effective date of the Regulation, within 6 months after the effective date;
  2. If they are established after the effective date of the Regulation, within 3 months from the date of obtaining the permission for the facility;
  3. For enterprises that meet an alteration in capacity or activity after the effective date, within 3 months from the date of change.

Transition Process and Effective Date

The first reporting year of the enterprises after the effective date of the Regulation has been determined as the first full calendar year. In addition, different effective dates for different sectors are determined. According to Article 26 of the Regulation, from the activities specified within the scope of the Regulation shall enter into force;

  1. On the date of publication for the energy,metal production and processing sectors,
  2. One year after the publication date for the mineral/mining and chemical industry,
  3. Two years after the date of publication for waste and wastewater management, paper, wood production and processing sectors,
  4. Three years after the publication date for animal and plant based products  and other actions in intensive livestock and aquaculture, food and beverage sectors.
  5. The other provisions enter into force on the date of publication.

Scope

Generally; energy sector, metal production and processing, mineral/mining industry, chemical industry, waste and wastewater management, paper and wood production and processing, animal and plant based products  and other actions in food and beverage sectors, fiber and textile pre-treatment, the facilities for pretreatment and dyeing of fibers and textiles are included in the scope of the Regulation, and the enterprises that are liable under the Regulation are listed in detail in Annex-1 of the Regulation.

Conclusion

The enterprises that are included in the scope of the facilities specified in Annex-1 of the Regulation must fulfill their registration and reporting obligations within the periods determined by the Regulation. Otherwise, the such enterprises will be subject to administrative sanctions under the Environmental Law.
